New Mexico Fiber Optic Cable Settlement

       

Update:  December 9, 2016

On July 24, 2015, a notice of appeal of final settlement approval was filed.  On August 29, 2016, the 10th Circuit Court of Appeals affirmed the New Mexico trial court’s settlement approval order. The deadline for any further appeals has now passed and the New Mexico settlement is now final.  Claim forms will be mailed shortly.  If your mailing address has changed, please contact us by mail or by calling the settlement toll-free number and inform us of the change.

Update:  July 29, 2015

On July 24, 2015, a notice of appeal of final settlement approval was filed. Claim forms will not be mailed until after that appeal is resolved. This process is expected to take several months. If final approval of the settlement is granted, claim forms will be mailed at that time. You should check the settlement website for updates. If your mailing address changes, please contact us by mail or by calling the settlement toll-free number and inform us of the change.

Update:  June 29, 2015

The Court approved the settlement on June 25, 2015. If there are no appeals, claim forms will be mailed in August 2015.

Update:  April 27, 2015

The Court has rescheduled the Final Fairness Hearing.  The Hearing will now be held on May 28, 2015 at 1:30 p.m. in 580 Brazos Courtroom.

Fager v. CenturyLink Communications LLC settlement website. This website has been established to provide information regarding a Settlement in a class action involving land next to or under railroad rights of way in New Mexico where CenturyLink, WilTel and Level 3 Communications (“Defendants”) have installed Telecommunications Facilities (such as fiber-optic, copper, or coaxial cables for the transmission of voice or data). The Settlement resolves litigation over whether the Defendants had the right to install Telecommunications Facilities within the railroad rights of way without the consent of people who own land next to or under the rights of way.



The Settlement will pay qualifying landowners’ claims and provide the Defendants certain telecommunications easement rights in the rights of way.

 

Your Legal Rights and Options in the Settlement

Submit a Claim Form

The only way to get a payment.  Claim Forms will be mailed after the Effective Date.

Exclude Yourself from the Settlement

Get no money from the Settlement.  This is the only option that allows you to ever be part of any other lawsuit against the Defendants about the legal claims in this case.  Current landowners avoid giving Defendants an Easement.

Object

If you do not exclude yourself, you may write to the Court about why you don’t like the Settlement.

Go to a Hearing

If you object, you also may ask to speak in Court about the fairness of the Settlement.

Do Nothing

Get no payment.  Give up rights to ever sue the Defendants or the railroads about the legal claims in this case.  Current landowners will be subject to an Easement.
